
TEAM Hx4 LLC d/b/a HUSTLE HOOPS WARMINSTER
MEMBERSHIP AGREEMENT, ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY
This Membership Agreement, Assumption of Risk, Waiver and Release of Liability ("Agreement") is entered into between HustleHoops70 LLC d/b/a Hustle Hoops Warminster ("Facility") and the undersigned participant, member, parent, or legal guardian ("Member").
By signing this Agreement, Member acknowledges and agrees to the following:
SECTION 1 – MEMBERSHIP TERMS
1.1 Membership Access
Membership provides access to Facility amenities, programs, and services as designated by the Member's selected membership plan. Membership benefits may vary by membership type.
1.2 Membership Type
All memberships are month-to-month unless otherwise stated in writing by Facility management.
1.3 Membership Dues and Billing Authorization
Member authorizes the Facility to automatically charge the payment method on file for recurring membership dues, fees, taxes, administrative charges, and other authorized purchases.
Member agrees to maintain valid payment information at all times.
1.4 Failed Payments
Returned ACH payments, chargebacks, declined credit card transactions, or other failed payments may be subject to a processing fee of up to $35 per occurrence.
The Facility reserves the right to suspend membership privileges until any outstanding balance is paid.
1.5 Membership Changes
The Facility reserves the right to modify membership dues, fees, operating hours, amenities, services, programs, policies, membership offerings, and benefits from time to time.
Members will receive at least thirty (30) days notice of any material membership fee increase.
Notice may be provided by email, text message, website posting, mobile application notification, social media posting, facility signage, or other reasonable means of communication.
Continued membership, payment of dues, or use of the Facility after the effective date of any modification shall constitute acceptance of the revised terms.
1.6 Membership Freeze
Members may freeze membership for up to three (3) months during any rolling twelve (12) month period.
Freeze requests must be submitted in writing at least fifteen (15) days prior to the next billing cycle.
A $10 monthly administrative fee applies during all approved freeze periods.
Membership access is suspended during any freeze.
1.7 Membership Cancellation
Membership may be canceled at any time with thirty (30) days written notice.
One final billing cycle will occur after notice is received.
Cancellation requests may be submitted through the Facility's designated cancellation process, by email, in person, or by mail.
Membership remains active through the final paid billing cycle.
1.8 Suspension or Termination
The Facility reserves the right to suspend, revoke, or terminate membership privileges for violations of Facility policies, unsafe conduct, disruptive behavior, non-payment, or actions deemed detrimental to the Facility community.
No refunds shall be issued for suspensions or terminations resulting from policy violations.
SECTION 2 – FACILITY RULES AND CODE OF CONDUCT
Members agree to conduct themselves in a respectful and sportsmanlike manner at all times.
The following are prohibited:
• Fighting, threatening behavior, or harassment
• Unsportsmanlike conduct
• Entering the playing surface to confront players, coaches, officials, or staff
• Illegal drugs, cannabis, vaping products, tobacco products, alcohol, or weapons
• Intentional damage to Facility property
Members are financially responsible for damage caused by themselves or their guests.
The Facility maintains a Zero Tolerance Policy regarding violence, harassment, and serious misconduct.
SECTION 3 – YOUTH PARTICIPATION AND DROP-OFF POLICY
The Facility is not a daycare center or childcare provider.
Youth members may only remain at the Facility while participating in scheduled programming, open gym activities, training sessions, camps, clinics, leagues, tournaments, or other approved activities.
Members may not use the Facility as an unsupervised drop-off location.
The Facility reserves the right to contact parents or guardians for immediate pickup when necessary.
Repeated violations may result in suspension or termination of membership.
SECTION 4 – GUEST POLICY
Guests must complete all required waivers before participation.
Guests under age 18 must have a parent or legal guardian complete required documentation.
Members are responsible for the conduct of their guests.
The Facility reserves the right to deny guest access at any time.
SECTION 5 – ASSUMPTION OF RISK
Member acknowledges that participation in basketball, sports performance training, strength training, conditioning activities, fitness programs, turf training, VertiMax training, weightlifting, cardio exercise, open gym activities, camps, clinics, leagues, tournaments, and related activities involves inherent risks.
These risks include but are not limited to:
• Falls
• Collisions
• Equipment failure
• Sprains
• Fractures
• Concussions
• Illness
• Permanent disability
• Death
Member voluntarily assumes all known and unknown risks associated with participation.
SECTION 6 – RELEASE OF LIABILITY
To the fullest extent permitted by law, Member releases, waives, discharges, and agrees not to sue HustleHoops70 LLC, its owners, officers, directors, employees, contractors, volunteers, affiliates, sponsors, landlords, and agents from any and all claims arising from participation in Facility activities or use of Facility premises, including claims arising from ordinary negligence.
SECTION 7 – MEDICAL AUTHORIZATION
Member certifies that they are physically capable of participating in Facility activities.
In the event of a medical emergency, Member authorizes the Facility to seek emergency medical treatment deemed appropriate.
Member accepts responsibility for all costs associated with such treatment.
SECTION 8 – MEDIA RELEASE AND VIDEO SURVEILLANCE
Member grants the Facility the unrestricted right to photograph, record, livestream, film, or otherwise capture images, video, or audio of Member or any minor participant for marketing, promotional, educational, operational, security, and social media purposes.
The Facility utilizes video surveillance and automated recording systems throughout portions of the premises.
Member waives any claim to compensation or ownership related to such recordings.
SECTION 9 – LOST OR STOLEN PROPERTY
The Facility is not responsible for lost, stolen, or damaged personal property.
Members are responsible for securing their belongings.
SECTION 10 – MINOR PARTICIPANTS
Parents and legal guardians signing on behalf of a minor certify that they have authority to execute this Agreement and assume all obligations and responsibilities on behalf of the minor participant.
SECTION 11 – GOVERNING LAW
This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania.
Any legal action arising under this Agreement shall be brought exclusively in Bucks County, Pennsylvania.
The parties may voluntarily agree to mediation or arbitration before pursuing litigation.
SECTION 12 – AGREEMENT ACKNOWLEDGMENT
Member acknowledges that they have carefully read this Agreement, understand its contents, understand that legal rights are being waived, and voluntarily agree to all terms and conditions.
This Agreement shall remain in effect for all future visits, programs, memberships, rentals, leagues, camps, clinics, tournaments, and activities conducted by the Facility unless revoked in writing and accepted by Facility management.
