PARTICIPANT AGREEMENT WAIVER AND RELEASE OF LIABILITY
For the purposes of this agreement, all references to “HustleHoops70 LLC,” its owners, agents, employees, and affiliates shall collectively be referred to as “the Facility.” This definition applies throughout the entirety of this document.
Section A – Acknowledgment of Facility Use
By signing this agreement, I acknowledge that I am voluntarily participating in activities at Hustle Hoops Warminster (“Facility”), located at 650 York Road, Warminster, PA 18974. The Facility includes, but is not limited to, basketball courts, weight and fitness areas, turf training areas, locker rooms, offices, and multipurpose spaces used for 1-on-1 and group training, youth and adult camps, clinics, tournaments, and related events.
Section B – Assumption of Risk
I understand that participation in physical activities involves inherent risks of injury, illness, property damage, and in extreme cases, permanent disability or death. These risks may be caused by my own actions, the actions of others, or conditions of the premises or equipment. I voluntarily assume all known and unknown risks.
Section C – Release of Liability and Indemnification
In consideration of being allowed to participate at the Facility, I, on behalf of myself and any minor(s) named below, hereby waive, release, and discharge Hustle Hoops Warminster, its owners, affiliates, agents, employees, volunteers, and successors from all liability for injury, loss, or damage to person or property, including those caused by negligence. I agree to indemnify and hold harmless the Facility against any claims arising from my participation or presence at the Facility.
Section D – Medical Acknowledgment and COVID-19
I affirm that I am (or my child is) in good health and able to safely participate in physical activity. I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk of exposure. I agree not to attend or allow participation if experiencing symptoms of COVID-19, under quarantine, or recently exposed.
Section E – Membership Terms, Freeze, and Cancellation Policy
Membership at Hustle Hoops includes access to the facility’s basketball courts, turf, weight and fitness areas, and participation in training programs, clinics, camps, and tournaments as applicable.
Freeze Policy: Members may freeze their membership for up to three (3) months during any twelve (12) month period. All freeze requests must be submitted in writing, in person, using a Membership Freeze Request Form and approved by Facility management.
During the freezing period, a reduced monthly administrative fee of $10 per month per membership will be charged. Membership access is suspended during the freeze.
Cancellation Policy: Members may cancel their membership agreement at any time, in person, by submitting a written notice using a Membership Cancellation Request Form at least thirty (30) days in advance.
Cancellations will include one final billing cycle following the date of notice. Membership remains active until the end of that final billing cycle. Cancellation is not confirmed until written confirmation is provided by Facility management. Family memberships may convert to individual plans if not all members are canceled.
If a canceled membership is re-activated before the expiration date, it may resume at existing terms. Otherwise, re-joining will be subject to current rates and initiation fees at the time of re-enrollment.
Section F – Media & Content Release
I grant Hustle Hoops the right to use photographs, video, or audio recordings of myself or my child for marketing, advertising, promotional, or educational purposes. I waive any right to inspect or approve the final materials and understand that no compensation will be provided.
Section G – Property Loss
I understand that Hustle Hoops is not responsible for any lost, stolen, or damaged personal property. I am responsible for securing my belongings during my time at the Facility.
Section H – Minor Participants
If signing on behalf of a minor, I certify that I am the parent or legal guardian and have authority to waive and release liability on their behalf. I have explained the risks and responsibilities to the minor.
Section I – Medical Treatment Authorization
I understand and acknowledge that Team Hx4 LLC (“the Facility”) does not have a duty to provide medical assistance, first aid, or emergency care of any kind. I release and hold harmless the Facility and its staff, agents, owners, and affiliates from any failure or refusal to administer medical aid or respond to a medical emergency. In the event of a medical emergency, I authorize the Facility and its representatives to seek emergency medical treatment as deemed necessary. I accept full responsibility for all costs associated with any such treatment, transportation, or related services.
Section J – Governing Law and Dispute Resolution
This agreement shall be governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved by binding arbitration administered by JAMS or AAA within 50 miles of the Facility.
Section K – Sponsorship & Advertising
By entering this Facility, participants acknowledge that Hustle Hoops reserves the right to display sponsor logos, advertising banners, and branded materials during programming and events. These sponsors help fund youth development and community-based programs.
Section L – Agreement Acknowledgment
I have read this agreement in its entirety. I understand its terms and that I am giving up legal rights by signing. I sign this agreement freely and voluntarily. This agreement is binding upon me, my heirs, assigns, and legal representatives.
Section M – Extended Stay & Drop-Off Policy
To maintain a safe, structured, and supervised environment, all participants and guardians agree to the following policies regarding time spent at the Facility:
1. Scheduled Participation Only
Youth members may only be on-site during their scheduled training sessions, programs, camps, clinics, or designated open gym hours. The Facility does not provide general supervision outside of these times.
2. No Daycare Services
Team Hx4 LLC does not operate as a daycare or drop-off childcare provider. Children and teens may not be dropped off and left at the Facility for unscheduled or extended periods without active participation in structured programming.
3. Extended Stay Fees
Members requiring extended supervision (defined as 3+ hours per day outside of scheduled programming) must enroll in an approved extended stay plan at an additional rate of $100 per week, in addition to any existing membership dues. Approval and coordination must be arranged in advance with Facility management.
4. Immediate Removal for Policy Violation
Any child or teen left unsupervised or on-site during adult programming, or otherwise in violation of this policy, may be asked to leave the Facility. Continued violation may result in suspension or cancellation of membership without refund.
5. Parent/Guardian Responsibility
Parents and guardians are fully responsible for arranging appropriate transportation and pick-up times. The Facility is not liable for injuries or incidents that occur during unsupervised time outside of scheduled programs.
